By accessing https://hubme.id, you are deemed to have read, understood, understood and agreed to all contents in the Terms and Conditions. At any time we reserve the right to change, modify, add or delete the Terms and Conditions listed without prior notice. You are encouraged to read the Terms and Conditions periodically. By continuing to visit and/or use this platform, you signify your agreement and legally accept, submit to and be bound by the Terms and Conditions of the Hubme software platform.
1. GENERAL TERMS AND CONDITIONS
1.1.Definitions
The use of the following terms will be repeated, linked, complementary and have the same explanatory meaning both in the site content. "Privacy Policy" and "Terms and Conditions" as follows:
1. "Company", "DMS Group", "We" refers to PT. Digital Mediatek Solusindo has copyright and intellectual rights as a professional expert in the field of Digital Platform, Web & Apps Mobile Development, Artificial Intelligence for various industry segments.
2. "Application", "Web Application" describes a web-based application through the URL https://www.hubme.id has a link generator feature service that can be accessed through a desktop site or based on Android or iOS.
3. "Hubme.id", "Hubme" is a trademark or product name of link generator software that can integrate with pixels (Pixel Integration) which has the function and role to track user activity and collect data for marketing or advertising purposes and user analytics.
4. "User" is a party who uses Hubme services to register, get a personal account, create a unique name (Username) to use the service features in this application. Users have 2 categories, namely
- Unpaid users (Free Subscription)
- Paid users (Paid Subscription).
5. "Personal Account", "Account" means the identification of Hubme Users who gain access and/or use services in the web application through the Username/password created by the User during registration.
6. "Active Personal Account", "Active Account" includes users who verify their email, create and/or own at least one of Hubme's features and services and have a maximum last login of 1 (one) year.
7. "Inactive Personal Account", "Inactive Account" includes users who verify email, create and/or have at least one of Hubme's features and services and have a last login of more than 1 (one) year.
8. "Verified Account" is a mark that Hubme has confirmed the authenticity of the account owner who represents a public figure, celebrity or global brand. The purpose of a Verified Account is to authenticate the owner of the original registered account.
9. "Data", "Personal Data" is a collection of personal data that can be used to identify Users. At any time if necessary Hubme may collect personal data consisting of full name, e-mail, mobile phone number, gender, date of birth, bank account details, or other required by the Company.
10. "Audience" is a third party that is shared or receives links to features in this web application by Hubme users.
11. "Products", "Services", "Hubme Services" consist of Main Services, Special Services and Additional Services (Additional Facilities and/or Programs) offered to users through the Hubme web application which we may add, change and / or update at any time. This hubme service has 3 categories of levels (Grade), namely:
- Limited Features and Services (Standard),
- Unlimited Features and Services (Premium),
- Cuztomize Features and Services (Cuztomize).
12. "Service Price" is the rate for Hubme products or services listed on the web application as an option for users who require Hubme premium services. The service prices listed on this web application will be borne by the paid user (Paid Subscription) including Value Added Tax (VAT).
13. "Affiliate", "Affiliate Partner" is a service facility and/or program in the form of a partnership or relationship between users and Hubme for the purpose of marketing, selling or promoting Hubme's products or services. In the context of promoting these products or services, users will receive commissions or rewards for sales generated in accordance with the provisions set forth in these Terms and Conditions.
14. "Affiliate Link" means a unique link or links provided by Hubme to be used by users to upload affiliate links for marketing, selling or promoting Hubme's products or services.
15. "Intellectual Property Rights" where specifically in this site confirms the Intellectual Property Rights and licensed copyrights belonging to the Company including but not limited to domain names, the Site, html code, content, copyrights, service marks, trademarks, logos, icons, symbols, or other code, software all information and materials, text, data, graphics, images, sound, video, all other content or design are protected by copyright laws. The company is protected by Copyright license has other rights to the selection, coordination, arrangement and creation of content or improvement of content.
1.2. Information and Materials
The information and materials on this web application are published in good faith solely to provide products and services. Unauthorized use of the web application and system outside of the Terms and Conditions stated in this web application, including but not limited to unauthorized access to the system or misuse of services contained in the web, is strictly prohibited. Reference to services on the web is interpreted as an offer to sell or provide such services. The user's interest in a particular service is determined by the final determination and approval of the user and/or his/her affiliates.
1.3. Links
This web application may contain links to sites controlled or provided by third parties whether or not affiliated with Hubme. Hubme hereby disclaims liability for any information, materials, products or services contained or offered on third party sites linked to this web application. By creating links to third party sites, Hubme does not endorse or recommend any products, services or information contained on such third party sites and we are not responsible for any failure of products offered or advertised on third party sites. It is likely that third parties have different privacy rules than Hubme and it is likely that third party sites offer less security than the Hubme web application.
2. USER TERMS AND CONDITIONS
Every user who accesses and/or uses the services in this web application is required to comply with the following terms of use:
1. Users are at least 18 years old, have been married or have the requirements in the category of adult users / regardless of child protection laws.
2. Users under 18 years of age must be supervised and approved by an adult / parent to use the services in this web application.
3. Users are not allowed to load and publish content that violates the terms of all services provided by Hubme and causes Hubme losses both morally and materially, including the following:
a) Content that contains the spread of false information or hoaxes that can harm others.
b) Content that contains pornography or adult content that is not in accordance with social and religious norms.
c) Content that contains elements of violence or threats against others.
d) Content that contains insults, slander, or defamation against certain individuals or groups.
e) Content that violates the copyright or intellectual property rights of others.
f) Content that contains elements of discrimination against race, religion, gender, or certain groups.
g) Content that contains invitations or encouragement to commit criminal acts or violate other laws.
4. Hubme always endeavors to keep the service safe, convenient and able to function properly, however Hubme cannot guarantee the operation and services in the site can be used perfectly or the information and data in the site have the possibility of not occurring in real time.
5. Hubme reserves the right to replace, change, suspend or discontinue all or part of the service, limit certain features in the web application at the Company's internal discretion and without the obligation to provide notice to users.
2.1. User Account Registration
1. To use the products and services offered, users are required to go through the registration process on the Hubme web application.
2. Registration is only done once with an account validity period according to the provisions that have been regulated. (there is a time limit)
3. Users are required to ensure the truth and accuracy of any data, information and / or information in any form that from time to time users submit or that users include in the Hubme web application. All forms of data provided are the responsibility of the user, if the user informs invalid or false data, Hubme is released from all losses of users and / or user audiences (third parties).
4. Users are required to update information if the previous user data is no longer valid. Hubme is exempted from any losses caused by user data that is no longer valid.
5. Users shall maintain the security and confidentiality of account passwords and/or other identification provided in the application to any party that may cause loss, damage or misuse of the account.
6. Hubme will not ask for usernames or passwords belonging to user accounts for any reason, therefore Hubme urges users not to provide such data or other important data to parties on behalf of Hubme or other parties whose security cannot be guaranteed.
7. Users must maintain ownership of personal accounts, it is strictly forbidden to transfer or transfer accounts, trade accounts to any party for any reason.
8. Hubme is not responsible if the user makes negligence in maintaining the security and confidentiality of personal account ownership that causes loss or damage or misuse of the account.
9. Hubme still considers valid and follows up on the transaction process without any obligation to identify and / or verify the actors who use and make transactions on the account. The user account owner is fully responsible for the transactions made and transactions cannot be canceled for any reason. Hubme is not responsible for any transaction losses caused by misuse of the account by other unauthorized user actors.
10. As a means of brand awareness, Hubme provides verified account facilities with a verified Page badge. Hubme provides a special user link on the biolink generator feature to request a verified account and will go through an evaluation process with the following conditions:
a) Complete the profile / known as (known as) and its category
b) Have sufficient popularity on social media / internet
c) Authenticity / validity of the account owner by attaching personal data, company / business data.
d) Users have facilities in more than one biolink personal account then the user must request a verified account for each biolink page (page).
2.2. Categories and Use of Hubme Services
When a user accesses, registers a personal account and uses every feature and service on the Hubme web application, the user has the right to enjoy and determine the use of service features and facilities with different levels or levels according to user needs as follows:
2.2.1. Non-Paid Users (Free Subscription)
a) Hubme provides a large selection of services, certain Hubme service options are provided free of charge with limited features and services (Standard).
b) Hubme provides paid subscription trial services for a period of time at no cost and/or at a lower price. By using the Hubme Service through a Trial, the User gets unlimited features and services (Premium) for a predetermined duration.
c) At the end of the trial duration if the user cancels / does not continue the unlimited features and services (Premium) by not making payment, Hubme will discontinue these unlimited features and services (Premium) in the future and cannot register for a trial again, the user account will return to being a non-paid User (Free Subscription) with limited features and services (Standard).
d) At any time if a non-paid user (Free Subscription) who has used the trial service wants to use unlimited features and services (Premium) again, the user can immediately make a payment transaction.
e) If a non-paid user account (Free Subscription) does not log in for more than 1 (one) year, Hubme will deactivate the account. The risk of deactivating the account is that other users have the right to use the unique name (username) of the inactive user. However, if a user who has a unique name (username) is not owned by another active user and the user wants to activate the unique name (username), please click the Account reactivation link.
2.2.2 Paid Users (Paid Subscription)
a) Hubme provides many service options, Hubme service options are provided on a paid basis with unlimited features and services (Premium).
b) Hubme will charge the price of services with unlimited features and services (Premium) by means of a paid subscription (Paid Subcription), service price payment transactions can be made using the Recurring Payment and One Time Payment methods set out in the Hubme platform.
c) Hubme uses a third party (Payment Gateway Platform) to serve all premium service payment transactions. Users are not responsible for any fees charged by Hubme's third parties other than the Service Prices listed in the Hubme web application.
d) The payment method is determined by the user's subscription (Subscription) with the recurring transaction method (Reccuring Payment) this is done automatically from Hubme's third party platform. Users subscribing to the recurring transaction method can choose payment for a monthly or annual period. Meanwhile, users subscribing to the One Time Payment transaction method will only make one payment transaction for a lifetime usage period.
e) Users will be fully responsible and hold Hubme harmless from any claims for payment of taxes, duties, or government levies, or other fees that may be imposed on Hubme services.
f) If the user cancels the paid subscription for unlimited features and services (Premium) or if the user's paid subscription payment is interrupted then Hubme will discontinue the unlimited features and services (Premium) in the following month and the user's personal account reverts to an unpaid user with limited features and services (Standard).
g) For users who downgrade to Standard, the user's data/files when using the unlimited feature will not appear but the data/files can be seen if the user upgrades to Premium again.
h) If the user intends to stop the subscription but the autodebit payment has been made first, the user cannot make a refund. Users are encouraged to terminate paid subscriptions for the future.
i) Paid Subscription users are considered active users as long as the user continues to make subscription payments even though the user has not logged in for more than 1 (one) year, especially for users with the One Time Payment method.
j) Paid Users (Paid Subscription) can collaborate by inviting a team (Team) of a maximum of 5 (five) people to increase productivity and creativity when creating link generators. If at any time the user downgrades the service level (Downgrade), unlimited features and services (Premium) will stop and both the user and the team (Team) return to being a Free User (Free Subscription) with limited features and services (Standard).
k) At any time Hubme may change the price of the service, Hubme will notify it as soon as possible or no later than 14 working days to the user before the change takes effect.
2.3. Deactivation of User Personal Account (Block)
2.3.1. Hubme reserves the right to temporarily or permanently deactivate or block a user's account if the user is proven to misuse the account and
perform actions that harm Hubme and/or Hubme's third parties (if any) materially and non-materially.
2.3.2. The causes of deactivation or blocking of a user's personal account include but are not limited to the following events:
a) Block requests from authorities, government or police.
b) Reports that the user's mobile phone has been lost, hacked, or stolen which causes the loss of the user's account.
c) Part or all of the important data submitted by the user is incorrect, incomplete, fictitious, false and/or misleading.
d) There is abusive use or indications of transactions that are detrimental to Hubme.
e) Actions that are not in accordance with these terms and conditions, Hubme policies and/or other related provisions.
f) Fraud or other crimes that harm Hubme.
g) Other parties reporting suspicious actions from user accounts accompanied by evidence deemed sufficient for Hubme's investigative purposes.
h) Based on Hubme's own judgment and authority on the validity of the user account.
3. HUBME SERVICES
3.1. Main Service (Limited and/or Unlimited)
Consists of features such as BioLink, Virtual Business Card, Short URL, Event Link, File Link, Static Site, OR Code, Splash Page and Tools that can be used via web and/or mobile (Andriod and iOS). The definitions of these features are as follows:
1. Bio Link is a collection of profile links or social media account bios that are linked into one link, this bio link is used to facilitate access for audiences who get links to view the content that users share.
2. Vitual Business Card, V-Card Link is a digital business card that can display a lot of more interactive information that previously could not be displayed on conventional business cards so that it can attract audience interest.
3. Short URL is a feature to make long links shorter, simpler, easy to remember, concise and can even change the URL name according to user needs.
4. Event Link is a feature to build a link to a higher quality event, so that users can analyze it in the dashboard to see statistics on audience response and participation in the event.
5. File Link is a link or shortcut that connects or directs users to a file or folder that has been uploaded on the Hubme web application with a predetermined file capacity. Link files can also be renamed and shared with the audience.
6. Static Site is a genius website or landing page consisting of HTML, CSS, JavaScript and Image files that are presented to users without a dynamic content management process.
7. QR Code or QR Code Generator is a tool used to create QR (Quick Response) codes in the form of two-dimensional barcodes that can store information such as text, URLs, or contact information in the form of images that can be easily scanned using a cellphone camera or other QR scanner device.
8. Splash Page is the initial page or opening page that appears on the website before the user is directed to the main page of the site. The splash page usually contains image content, animation, a welcome message, or links to other important pages on the website.
9. Useful Tools or Tools refer to various types of software support tools or concepts that can be used to facilitate work, problem solving or goal achievement in an easier and more efficient way.
3.2. Specialized Services
Specialized services are divided into 2 categories, namely:

2. Partnership
Hubme Special Services provides partnerships for users who want to work together with more profitable benefits by Contact Us here.
4. PROMOTION or OTHER SERVICES PROGRAMS
1. Promotions or Service Programs held by Hubme are not related or cannot be confused with Hubme's third party promotions or service programs and vice versa.
2. At any time Hubme reserves the right to hold promotions, advertisements or service programs from in accordance with Hubme's policies.
3. At any time Hubme reserves the right to eliminate and/or refuse certain services without prior notice if the promotion or service program does not comply with Hubme's policies.
4. Hubme will assist Platform Users if Platform Users have transacted with service programs that are not available by the Vendor with the terms and conditions of the Company's policy.
5. DISPUTE RESOLUTION
1. If a user has a dispute with one or more other users, then the user releases Hubme (including its parent company, Directors, and employees) from claims and demands for damages and losses (actual and implied) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. The user thereby knowingly waives any legal protections that would limit the scope of this waiver provision.
2. The user understands and agrees that any losses arising from the aforementioned actions, including but not limited to lost profits, business opportunities, or subpoenas, suits and/or other efforts filed by third parties, are not the responsibility of Hubme.
